Terms of Service for Plexic Pix/Solomon Briggs – Photography Services
Please read these Terms of Service carefully. By proceeding with payment for our services, you acknowledge that you have read, understood, and agree to be bound by these terms.
1. Introduction
These Terms of Service (“Terms”) govern the provision of property photography services by
Plexic Pix/Solomon Briggs
(“Photographer,” “we,” “us,” or “our”) to you, the client (“Client” or “you”).
2. Services Offered
We provide on-location property photography services, including a 15-30 minute photography session, up to 30 minutes of photo editing, and digital delivery of 20-35 image files via email within 48 hours of the session.
3. Booking and Appointments
- Scheduling: Appointments are scheduled via website, phone or email correspondence.
- Confirmation: All appointments require confirmation by both the Client and the Photographer.
- Punctuality: The Photographer will arrive at the scheduled time. It is the Client’s responsibility to ensure the property is accessible and ready for photography at the agreed-upon time. Delays caused by the Client may result in reduced photography time.
- Rescheduling/Cancellation: If you need to reschedule or cancel an appointment, please provide at least 24 hours’ notice. Failure to provide sufficient notice may result in a cancellation fee of $25. No-shows will be charged the full service fee.
4. Payment Terms
- Fee: The standard fee for one property photography session is fifty dollars ($50.00).
- Payment Due: Full payment of $50.00 is required and due before the commencement of the photography session.
- Payment Method: Payments are securely processed through Wave (via credit card, bank transfer, or other available methods). Applicable processing fees (if any) are applied at the time of transaction.
- Non-Refundable: Once the photography session has begun, the service fee is non-refundable. In the event of a cancellation with less than 24 hours’ notice or a no-show, the fee (or a portion thereof, as per Section 3) is non-refundable.
5. Photography Session
- Duration: The on-site photography session will last approximately 15-30 minutes.
- Property Readiness: It is the Client’s responsibility to ensure the property is prepared and visually appealing for photography prior to the Photographer’s arrival. The Photographer will photograph the property “as-is” upon arrival.
- Access: The Client must ensure the Photographer has unobstructed access to all areas of the property to be photographed.
6. Photo Delivery
- Quantity: You will receive between 20-35 edited digital image files.
- Delivery Method: Photos will be delivered electronically via email (e.g., through a secure download link) to the email address provided by the Client.
- Delivery Timeframe: Edited photos will be delivered within 48 hours following the completion of the photography session.
- File Format: Images will typically be delivered in high-resolution JPEG format.
7. Usage Rights and Copyright
- Client Usage: The Client is granted a non-exclusive, non-transferable license to use the delivered photographs for the purpose of marketing, selling, or leasing the specific property photographed (e.g., real estate listings, personal promotional materials). This license does not permit the resale of the photographs or their use in any other commercial venture without explicit written agreement from the Photographer.
- Copyright: The Photographer retains all copyrights to all photographs taken during the session.
- Photographer’s Use: The Photographer reserves the right to use any photographs for portfolio, marketing, or promotional purposes.
8. Limitation of Liability
The Photographer will exercise reasonable care and skill in providing the services. However, the Photographer’s liability for any loss or damage, including but not limited to technical malfunctions, data loss, or dissatisfaction with the photographic results, shall be limited to the amount paid by the Client for the specific service from which the loss or damage arose.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law principles.
10. Acceptance of Terms
By proceeding with payment for our property photography services, you indicate your full acceptance of these Terms of Service.
